



I got a junk fax earlier (nothing new - with 2 fax numbers coming in, we get a half dozen a day easy), and when I picked it up and then crumpled it to go for 3 pts, I got a papercut.
I know I can go after the Junk Faxer for the junk fax (an illegal act), but can I have him charged with a felony now too? After all, he caused me injury as a result of his illegal act.
Things to ponder.

I don’t know. We had someone put something in our mailbox once… supposedly a felony. We called the postmaster up and he laughed at us.
Heheh, yeah, I guess they would look funny on that. Just an FYI. I had dealt with a case a few years ago involving the mailbox issue. Here’s what I learned:
There is a crime (felony) for tampering or hindering with the US mail or containers used to collect/distribute such mail. Placing ads, junk mail, flyers, newspapers, etc in a homes mailbox is not called tampering/hindering, so it’s usually ok.
The police would not prosecute this offense anyways, as it’s a Federal and not local matter. It would first be investigated by the Postal Inspectors (they have full federal police authority), and then possibly bumped up to the FBI and prosecuted by an Asst US Attny.
Reason I knew this: Those pesky anthrax scares a few years ago. A hint: placing a letter covered with powder in a mailbox in an atempt to cause a panic IS tampering/hindering. It’s also “terroristic” and just plain “Stupid.” And having the letter go to a government official (like a judge going over your case): Immensly Stupid.
